General

By using the Calcutta Records website and placing an order, you agree to comply with these Terms & Conditions and all applicable laws and regulations of India. If you do not agree, you are prohibited from using or accessing this site.

You must be at least 18 years of age to enter into a contract with us. By placing an order you confirm that you meet this requirement. If you are purchasing on behalf of a minor, you accept personal liability for the transaction.

Our registered legal entity is House of Avika Private Limited. These terms are governed by the laws of India.

Products & Condition Descriptions

We sell physical music media and audio equipment across three broad categories: (1) pre-owned second-hand items sourced from the secondary market; (2) international imports sourced from overseas distributors and suppliers; (3) new items sourced from authorised local distributors. Each product listing includes our best-faith description of the item's condition.

While we strive to accurately describe every product, listing descriptions (including grading, pressing details, and sleeve condition) are our good-faith assessments at the time of listing. In rare instances, minor discrepancies between the description and the actual item are possible. We address such cases individually — if you receive an item with a significant discrepancy from the description, please contact us within 7 days and we will offer a resolution (replacement, exchange, or refund as appropriate). Minor wear consistent with the stated grade does not constitute a discrepancy.

For pre-owned items we use the internationally recognised Goldmine Grading Standard. Grading is inherently subjective and playback experience may vary across different equipment configurations and listener expectations.

Pre-Owned Goods & Secondary Market Provenance

Pre-owned items sold by Calcutta Records are sourced from the open secondary market — including individual collectors, dealers, and general trade sources. While we make reasonable efforts to verify the items we acquire, we cannot warrant the original chain of title, licensing history, or manufacturing authenticity of every historic pressing.

Some items in our pre-owned inventory may be vintage pressings manufactured decades ago under licensing arrangements we cannot independently verify. By purchasing a pre-owned item, you acknowledge that:

• You are purchasing a physical second-hand artefact from the secondary market.
• Calcutta Records is a bona fide purchaser of these items and does not manufacture, license, or represent the original rights holder.
• The doctrine of exhaustion (first sale) applies to lawfully manufactured originals; Calcutta Records makes no warranty regarding items that may have been manufactured without authorisation by original rights holders.
• If you have reason to believe a specific item is the subject of a theft report or ownership dispute, you must notify us immediately and not proceed with purchase.

Import & International Orders

International import orders are sourced from our overseas suppliers and procured specifically for you once your order is confirmed. All applicable customs duties, taxes, and GST are paid by us.

All import orders are final sales. No cancellations or refunds will be accepted once an import order has been placed with our supplier. This includes Japanese pressings, European imports, and any other title sourced internationally on your behalf.

Estimated delivery timelines for import orders are indicative only. Delays may occur due to international shipping, customs clearance, supplier availability, or factors beyond our control. We will keep you informed of material delays but cannot guarantee delivery by any specific date.

GST Invoice

We issue GST-compliant invoices on all orders. If you require a B2B GST invoice with your GSTIN, you may enter your GST number at the time of checkout. If you forget to add it during checkout, please email us at [email protected] with your order number and GSTIN within 24 hours of placing the order and before dispatch. We are unable to amend GST details on invoices once the order has been dispatched.

Payment

We accept payment through secure payment gateways including Razorpay, PhonePe, and PayPal. Payment must be made in full before we dispatch your order. Cash on Delivery (COD) is available for domestic orders across India subject to order value limits.

We offer EMI as a payment option on eligible cards through Razorpay. EMI availability is subject to your bank's eligibility criteria. The minimum order value for HDFC Debit Card EMI is ₹5,000. EMI interest rates and processing fees are charged directly by your issuing bank, not by Calcutta Records. EMI plans cannot be changed after an order has been placed.

EMI Refunds: If a refund is approved on an EMI order, we will process the refund to the original payment source after deducting applicable payment gateway charges. Your EMI arrangement with your bank continues independently — contact your bank to foreclose the EMI after receiving your refund. Calcutta Records is not liable for further EMI deductions by the bank after we have processed the refund.

Shipping & Delivery Delays

Please refer to our Shipping & Delivery Policy for full information on shipping options, charges, and estimated delivery times.

Delivery timelines are estimates, not guarantees. Orders may be delayed due to courier partner issues, vendor procurement delays, customs clearance, natural events, public holidays, or other circumstances beyond our reasonable control. We will notify you of significant delays affecting your order. Calcutta Records shall not be liable for losses arising from delivery delays caused by such circumstances.

Refunds & Returns

Please refer to our Return & Cancellation Policy for full details. In summary: refunds are issued only where an item is confirmed damaged in transit or an incorrect item was shipped. Pre-owned items are sold as-is and condition-related returns are not accepted unless there is a significant discrepancy from the stated grade.

Audio Equipment

Used audio equipment (turntables, amplifiers, receivers, cassette decks, etc.) is sold as-is. Any cleaning or functional testing we perform does not constitute a manufacturer's warranty or guarantee of continued performance. Calcutta Records shall not be liable for any property damage, personal injury, or consequential loss arising from the use of second-hand audio equipment purchased from us. Buyers are advised to have used equipment inspected by a qualified technician before use.

Limitation of Liability

To the fullest extent permitted by applicable law, Calcutta Records' total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific item giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of enjoyment, loss of profit, or loss of data.

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable Indian law.

Dispute Resolution & Governing Law

These terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms or any purchase shall first be attempted to be resolved through good-faith negotiation.

If not resolved within 30 days, disputes shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Kolkata, West Bengal, India. The language of arbitration shall be English. The arbitral award shall be final and binding.

Subject to the arbitration clause above, the courts of Kolkata, West Bengal shall have exclusive jurisdiction over any matter arising from these terms.

Force Majeure

Calcutta Records shall not be held liable for failure or delay in performance of any obligation under these terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government orders, strikes, customs delays, courier disruptions, supplier failures, or power outages. We will use reasonable efforts to notify you and minimise the impact of such events.

Privacy & Data

We collect personal information to process orders and provide customer support. We do not sell your data. Please refer to our Privacy Policy for full details, including your rights under the Digital Personal Data Protection Act, 2023.

Cookies & Ad Tracking

Our website uses cookies and ad tracking for remarketing purposes. By using our website, you consent to our use of cookies in accordance with our Privacy Policy.

Electronic Agreement at Checkout

When you place an order, you are required to confirm your acceptance of these Terms, the Return Policy, and the applicable product condition acknowledgments by ticking mandatory checkboxes at checkout. This electronic acceptance — together with the IP address, timestamp, and order details recorded at the time of placement — constitutes a legally binding agreement between you and House of Avika Private Limited, valid under Section 10A of the Information Technology Act, 2000.

Intellectual Property

All original content on this website — including our text, editorial copy, photographs taken by us, and design elements — is the property of House of Avika Private Limited and is protected by applicable copyright laws. Product imagery (album artwork) is displayed for identification purposes in connection with the sale of physical goods. You may not reproduce, redistribute, or use any of our original content without prior written consent.

Limitations on Service

We reserve the right to limit quantities, decline orders, or refuse service at our discretion. We also reserve the right to correct pricing errors and cancel orders placed at incorrectly listed prices, with a full refund.

Changes to These Terms

We may update these Terms at any time. The "Last Updated" date at the top of this page will reflect the most recent revision. By continuing to use our website after changes are posted, you accept the updated terms. For orders already placed, the terms in effect at the time of order placement apply.
